Allgemeine Geschäftsbedingungen (AGB)

1. Geltungsbereich 1.1 Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge, die über den Shopify-Onlineshop von Lakeside Atelier e.U. mit Sitz in 2700 Bad Fischau, Bad Fischau 606, zwischen uns und unseren Kunden abgeschlossen werden. 1.2 Abweichende oder ergänzende Bedingungen des Kunden werden nicht Vertragsbestandteil, es sei denn, wir stimmen ihrer Geltung ausdrücklich zu.

2. Vertragsschluss 2.1 Die Darstellung der Produkte in unserem Shopify-Onlineshop stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Abgabe eines Angebots. 2.2 Der Kunde gibt durch das Anklicken des Buttons „Jetzt kaufen“ ein verbindliches Angebot ab. Der Vertrag kommt zustande, wenn wir das Angebot des Kunden durch eine Bestätigung per E-Mail annehmen.

3. Preise und Zahlung 3.1 Alle Preise verstehen sich inklusive der gesetzlichen Mehrwertsteuer. 3.2 Die Zahlung erfolgt per Kreditkarte, PayPal oder über die anderen im Shop angebotenen Zahlungsmethoden. 3.3 Bei Zahlungsverzug behalten wir uns das Recht vor, Mahngebühren in Rechnung zu stellen.

4. Lieferung 4.1 Die Lieferung erfolgt an die vom Kunden angegebene Adresse. 4.2 Lieferzeiten sind für lagernde Produkte auf der Produktseite angegeben. Bei Bestellware behält sich Lakesider Atelier e.U. vor, die Lieferzeit je nach Auslastung anzuspassen. Bei Lieferverzögerungen werden wir den Kunden umgehend informieren.

5. Widerrufsrecht 5.1 Verbraucher haben ein gesetzliches Widerrufsrecht.  5.2 Das Widerrufsrecht besteht nicht bei individuellen sowie personalisierten Produkten, die sofort nach dem Kauf zur Verfügung gestellt werden.

6. Gewährleistung 6.1 Es gelten die gesetzlichen Gewährleistungsrechte. 6.2 Offensichtliche Mängel sind uns innerhalb von 14 Tagen nach Lieferung schriftlich mitzuteilen.

7. Haftung 7.1 Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit. 7.2 Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und beschränkt auf den vorhersehbaren Schaden.

9. Schlussbestimmungen 9.1 Es gilt das Recht der Republik Österreich unter Ausschluss des UN-Kaufrechts. 9.2 Sollte eine Bestimmung dieser AGB unwirksam sein, bleiben die übrigen Bestimmungen davon unberührt.

Lakeside Atelier (Eventagentur)

1. Vertragspartner & Buchung

Der Vertrag kommt durch schriftliche Buchungsbestätigung und Anzahlung zustande:

  • 50 % bei Auftragserteilung

  • Weitere 30 % bis 30 Tage vor der Veranstaltung

  • Restzahlung spätestens 7 Tage vor der Veranstaltung

2. Leistungen & Preise

Leistungen und Preise laut individuellem Angebot. Preisänderungen >10 % berechtigen zum Rücktritt. Externe Dienstleister nur nach Absprache.

3. Nutzungszeitraum & Regeln

  • Nutzung: 08:00–00:00 Uhr am Veranstaltungstag

  • Auf-/Abbau nur im vereinbarten Zeitraum

  • Musik nur im Außenbereich bis 22:00 Uhr

  • Keine Dekoration ohne Zustimmung

  • Mieter haftet für eingebrachte Gegenstände

4. Rücktritt & Storno

Stornierungen schriftlich und abhängig vom Zeitpunkt:

  • 6–2 Monate vorher: 50 % Stornogebühr

  • 2–1 Monat vorher: 75 %

  • Ab 8 Wochen: 100 %
    Bereits geleistete Zahlungen werden angerechnet.

5. Haftung

Der Veranstalter trägt die Verantwortung für:

  • Sicherheit der Gäste

  • Einhaltung gesetzlicher Vorschriften

  • Schäden an Einrichtung, Gelände, Technik
    Lakeside Atelier e.U. übernimmt keine Verantwortung für Organisation oder Schäden durch Dritte.

6. Datenschutz & Werbung

Der Kunde stimmt der Verarbeitung personenbezogener Daten zu. Fotos/Videos dürfen zur Eigenwerbung verwendet werden, sofern nicht widersprochen.

7. Gerichtsstand & Recht

Es gilt österreichisches Recht. Gerichtsstand: Wiener Neustadt.

8. Schlechtwetterregelung

Optional kann ein Indoorbereich für bis zu 100 Personen gebucht werden. Buchung spätestens 7 Tage vor Event. Verfügbarkeit vorbehalten.

1. Scope
1.1 These Terms and Conditions (T&Cs) apply to all contracts concluded via the Shopify online shop of Lakeside Atelier e.U., located at 2700 Bad Fischau, Bad Fischau 606, between us and our customers.
1.2 Deviating or supplementary terms and conditions of the customer will not become part of the contract unless we expressly agree to their applicability.

2. Conclusion of the Contract
2.1 The presentation of products in our Shopify online shop does not constitute a legally binding offer but an invitation to submit an offer.
2.2 By clicking the “Buy Now” button, the customer submits a binding offer. The contract is concluded when we accept the customer’s offer via confirmation email.

3. Prices and Payment
3.1 All prices include the statutory value-added tax.
3.2 Payment is made via credit card, PayPal, or other payment methods offered in the shop.
3.3 In case of payment default, we reserve the right to charge reminder fees.

4. Delivery
4.1 Delivery is made to the address provided by the customer.
4.2 Delivery times for in-stock products are indicated on the product page. For custom-made products, Lakeside Atelier e.U. reserves the right to adjust delivery times based on workload. In case of delivery delays, we will inform the customer immediately.

5. Right of Withdrawal
5.1 Consumers have a statutory right of withdrawal.
5.2 The right of withdrawal does not apply to individual or personalized products made available immediately after purchase.

6. Warranty
6.1 Statutory warranty rights apply.
6.2 Obvious defects must be reported to us in writing within 14 days of delivery.

7. Liability
7.1 We are fully liable for intent and gross negligence.
7.2 In cases of slight negligence, we are only liable for breaches of essential contractual obligations and limited to foreseeable damages.

8. Data Protection
Information on the collection and processing of personal data can be found in our Privacy Policy.

9. Final Provisions
9.1 The laws of the Republic of Austria apply, excluding the UN Convention on Contracts for the International Sale of Goods.
9.2 Should any provision of these T&Cs be invalid, the remaining provisions shall remain unaffected.

Lakeside Atelier (Eventagency)

1. Contracting Parties & Booking

The rental agreement is concluded upon written booking confirmation and receipt of the deposit:

  • 50% of the total amount upon booking

  • Additional 30% due 30 days before the event

  • Final payment due no later than 7 days before the event

2. Services & Pricing

Services and prices are based on the written offer. Price increases >10% (based on consumer price index) entitle the customer to withdraw. External service providers require prior approval.

3. Usage Period & Venue Rules

  • Rental period: 08:00–00:00 on the day of the event

  • Setup/teardown must take place within agreed time frame

  • Outdoor music allowed until 22:00 only; indoor music is not permitted

  • Decorations or technical setups require prior approval

  • Tenants are responsible for personal belongings and equipment. Lakeside Atelier e.U. assumes no liability for storage or damage.

4. Cancellation & Withdrawal

Cancellations must be made in writing. Cancellation fees apply based on timing:

  • 6–2 months before the event: 50% fee

  • 2–1 month before the event: 75% fee

  • Less than 8 weeks before: 100% fee
    Prepaid amounts will be credited toward these fees.

Lakeside Atelier e.U. may withdraw from the contract for important reasons. In that case, prepaid amounts will be refunded proportionally.

5. Liability

Lakeside Atelier e.U. acts solely as an intermediary and not as the organizer.
The tenant (organizer) is fully responsible for:

  • Compliance with public regulations

  • Safety of guests and third parties

  • All damage caused by guests, staff, or external suppliers

  • Damages to the venue, furniture, or technical infrastructure

No liability is accepted for weather-related limitations, cancellations, or restrictions. The tenant is solely responsible for returning the venue in clean condition. Extra cleaning efforts will be invoiced.

6. Data Protection & Advertising

By entering into the agreement, the customer agrees to the processing of personal data. Lakeside Atelier e.U. reserves the right to use photos/videos taken during the event for self-promotion unless the customer objects in writing.

7. Jurisdiction & Governing Law

Austrian law applies. The place of jurisdiction is Wiener Neustadt. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

8. Weather Contingency Option

An indoor backup area for up to 100 people can be booked as a contingency option. This must be confirmed at least 7 days before the event. Availability is not guaranteed for short-term bookings. Costs will be quoted separately.
